Under The Rainbow Consultant Agreement

By joining Under The Rainbow Gifts Consultant Program, you are agreeing to all terms enclosed within this agreement. You furthermore understand that the details of Under The Rainbow's Gift Consultant Program & Consultant Terms is subject to change at any time for improvements or other reasons deemed necessary by Under The Rainbow. As an Under The Rainbow Gift Consultant it is your responsibility to review all terms & policies on a fairly regular basis to ensure compliance. Failure to comply with Company & Program terms and policies could result in the removal of Consultant Privileges.

• I understand that Under The Rainbow Consultants are not employees, franchise holders or legal representatives of Under The Rainbow. Consultants are Self-Employed Independent Contractors and are responsible for filing Federal and State taxes as such. Consultants will not be treated as an employee with respect to any state or local services including Unemployment Act’s or Worker’s Compensation Acts.
• I understand the Company owns trademarks and copyrights for its materials whether or not they bear a notice symbol. I will not use these materials (includes pictures, graphics, and quotes) in any form of advertising or to present myself as anything but an Independent Contractor (i.e. employee, spokesperson, legal representation) for the Company, without prior permission.
• I understand it is my sole responsibility to acquire payment for each order placed with the Company by me or my customers. If payment is not made at the time of order, then I understand the order will not be processed and products not shipped to any customers until payment is received. Under The Rainbow is not responsible for refunding customers for orders collected by me, nor will they. Furthermore, a customer will never be refunded for an order that was paid for by me and vice versa.
• I understand that it is my responsibility to keep all of my contact and payment information up to date. Payment failures due to my failure to update my account information are not the responsibility of Under The Rainbow.
• I understand that Consultant web sites will soon be available to me and will be encouraged by the company. Minimum retail sales requirements for a FREE Consultant Web Site is $100, otherwise there will be a set-up and monthly fee for a Consultant web site. I understand that if I do not wish to take advantage of the Consultant Web Site, then my customers may simply use my referral code for direct ordering credit or I can drop ship customer orders by placing their orders myself.
• I understand that Under The Rainbow reserves the right to, at their discretion amend or change any information included in the compensation plan, policies and Consultant guides. Notification of all changes will be published in any or all of the following; Consultant Area Announcement, Consultant Yahoo Group, Newsletter, E-Mail broadcast or letter circulated to all Representatives.
• I understand that is my responsibility to review and check for agreement changes, product updates, legal notices, restrictions, and any other policy or program changes. Failure to follow restrictions or terms posted in the Consultant terms section could result in termination void all due credits and bonuses for failure to comply with terms. Notification of all changes will be published in any or all of the following; Consultant Area Announcement, Consultant Yahoo Group, Newsletter, E-Mail broadcast or letter circulated to all Representatives.
• I understand that violating any of the above or the following code of conduct will result in immediate termination of this agreement and the loss of any future bonuses or incentives partially earned.
• I understand that if I wish to terminate my relationship with the Company, that I may do so at any time for any reason with a written notice given to the company. All credits due to me at the time of written cancellation will be paid in accordance to the current commission payment schedule. Termination without written request will void all due credits and bonuses.
• I understand that if I reach $250 in retail sales within 5 years of sign up, I will receive the cost of my sign up plus any qualifying Consultant Starter Kit refunded in Consultant credit. Furthermore, any qualifying Consultant Kit must be ordered within the 1st month of Consultant sign up to count for the stated refund credit.
• Barring any of the above, this agreement, contingent on approval of the Under The Rainbow's Main Office, will be in effect for twelve months and is automatically renewed on the anniversary date of the acceptance unless otherwise cancelled by a written notice by either party 30 days prior to renewal date.
